1. Contractual Partners

The purchase contract is concluded wiht ZWOD Vertriebs & Logistik GmbH (below „ZWOD"") Ferdinand-Schulze-Str. 91, 13055 Berlin.

2. Scope of Contract

For all mutual claims from and in connection with the conclusion of a contract for the delivery of goods between the customer (hereinafter also "you", "you") and ZWOD, these general terms and conditions always apply in the version valid at the time the respective contract was concluded. Orders on Zwod.eu are possible for everyone from the Federal Republic of Germany, EU and EU-neighboring countries.

3. Conclusion of Contract

3.1 The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog. By clicking the order button you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order will be sent by email immediately after we receive it. The confirmation of receipt does not constitute acceptance of the contract.
3.2 We can accept your order by sending a declaration of acceptance in a separate email or by delivering the goods within 12  to 16 working days, whereby the customer's access is decisive. If working days are specified as deadlines, this includes all weekdays with the exception of Saturdays, Sundays and public holidays. 
3.3 Your personal data and information that you provide us with are used by ZWOD to process orders, deliver goods and process payments. The delivery of the item you ordered is carried out by a transport company commissioned by us. For this purpose, we provide this transport company with your email address so that the transport company can send you information about the status of your shipments and a specific delivery date by email. 

4. Contract text storage and contract language

4.1 We save the contract text and send you the order details by email. You can also view the terms and conditions at any time at zwod.eu. You can view your previous orders in the "My orders" area if you have registered as a customer and logged in via the website with your access data.
4.2 The contract language is German and English.

5. Right of withdrawal 

Consumers have the following right of withdrawal:

You have the right to cancel this contract within 14 days without giving any reason.
The cancellation period is 14 days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.
In order to exercise your right of withdrawal, you must inform us (Zwod Vertriebs & Logistik GmbH, Ferdinand-Schulze-Str. 91, 13055 Berlin, info@zwod.eu, Tel .: 0170 463 08 76) by means of a clear statement (e.g. a Letters sent by post, fax or email) inform you of your decision to cancel this contract. You can use the attached sample cancellation form, but this is not mandatory.
You can also electronically fill in and submit the model withdrawal form or another clear declaration on our website zwod.eu. If you make use of this option, we will send you a confirmation of receipt of such a revocation immediately (e.g. by email).
To meet the cancellation deadline, it is sufficient for you to send your communication regarding your exercise of the right of cancellation before the cancellation period expires.

Consequences of cancellation
If you cancel this contract, we have made all payments we have received from you, including delivery costs (with the exception of the additional costs that result from the fact that you chose a different type of delivery than the cheapest standard delivery we offer have) to repay immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.
We bear the cost of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling that is not necessary for checking the nature, properties and functionality of the goods.
For goods that cannot normally be returned by post due to their nature and which are identified as such in the invoice as "bulky goods": We collect the goods.
The following applies to all other goods: We can refuse repayment until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is the earlier. You must send the goods to Zwod Vertriebs & Logistik GmbH, Ferdinand-Schulze-Str. Immediately and in any event not later than fourteen days from the date on which you inform us of the cancellation of this contract. 91, 13055 to be returned or handed over. The deadline is met if you send the goods before the 14 day period has expired.

6. Voluntary right of return
Without prejudice to your statutory rights, ZWOD offers you the following voluntary right of return: You can return all ZWOD products to ZWOD within 30 days of receipt of the goods without stating a reason. The return period is 30 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. If you exercise our voluntary right of return, you bear the shipping costs. Please address the shipments to:

We grant you this voluntary right of return on the following conditions:

· The goods are unused;

· The goods are undamaged;

· The goods are complete.

The voluntary right of return does not exist for

· Goods that are manufactured according to customer specifications or are clearly tailored to the personal needs of the customer;

· Goods that are configured according to customer specifications from standard components, such as B. individually configured computers, hardware with / without software installations as soon as they are used or put into operation;

· Kits assembled by customers and such parts that are already installed by the customer;

· Special orders from the customer, such as B. specially ordered for the customer

7. Data Backup  

Before returning devices with storage media, please note the following:
You are basically responsible for backing up the data yourself. Please make appropriate backup copies or delete any personal data contained. This is particularly important if personal data from third parties are stored.
If deletion is not possible due to a defect, we ask you to explicitly inform us of the presence of personal data. Please note this clearly on the return slip.

8. Reservation of self-supply

Should ZWOD not be supplied through no fault of its own, even though it has placed identical orders with reliable suppliers, ZWOD will be released from its obligation to perform and can withdraw from the contract. ZWOD will inform the customer immediately about the unavailability and, in the event of withdrawal, will immediately reimburse the customer for payments already made.

9. Delivery / shipping costs

9.1 All orders on zwod.eu are only delivered to customers with delivery addresses in the EU and EU neighboring countries.
9.2 In addition to the stated product prices, any shipping costs incurred are to be borne by the customer.
9.3 Subject to the self-delivery, ZWOD will ensure a quick delivery. If a part of the order cannot be delivered immediately because ZWOD was not responsible for delivering it in time through no fault of its own, even though it placed identical orders with reliable suppliers, the remaining goods will be delivered without recalculation of the shipping fee, insofar as this is reasonable for the customer.
9.4 Some products imported by ZWOD from the USA and / or manufactured in the USA are subject to the US and other, especially German export control regulations. The customer is responsible for compliance with the export control regulations and is advised that before exporting products and / or technical information that he receives from ZWOD, he may have to obtain necessary export licenses or other necessary documents at his own expense. The customer will also be informed that he is not allowed to sell, export, re-export, deliver or otherwise pass on products or technical information that are subject to export control regulations directly or indirectly to persons, companies (companies) or in countries, if this is against US American or other, especially German export control laws, ordinances, restrictions and stipulations violate. The customer is legally obliged to inform all recipients of these products or technical information about the need to comply with these laws and regulations.
The refusal of an export license does not entitle the customer to withdraw from the contract or to claim damages. ZWOD is not obliged to issue the customer with a supplier or long-term supplier declaration or to procure one from their own upstream suppliers.

10.Price, terms of payment

10.1 The prices in the online shop for consumers are total prices and include VAT. Any additional shipping costs that may arise are specified separately for the respective products.
10.2 In the case of payment in advance, we will send you our bank details by email, fax or post. After receiving this information, the purchase price must be received on our account within 7 days. We will then send the ordered goods to you
10.3 If the payment method PayPal has been agreed, you will be automatically forwarded to PayPal's secure payment form after submitting your order. If you already have a PayPal account, just log in. Otherwise, click Set up an account and follow the instructions. We will receive your payment within seconds and your goods can be shipped immediately upon availability.

11. Retention of title

ZWOD retains ownership of all goods it delivers to a customer until full payment has been made for the goods delivered.

12. Warranty

12.1 The statutory liability for defects applies to all goods.
12.2 Should the delivered goods show obvious transport damage, the customer is asked to report such errors to ZWOD as soon as possible. Failure to do so will have no consequences for your statutory claims and their enforcement, especially your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance. If the customer acts as a merchant within the meaning of Section 1 of the German Commercial Code (HGB), the commercial duty to examine and give notice of defects applies in accordance with Section 377 HGB.
12.3 The period of liability for warranty claims for used goods marked as refurbished and / or demonstration goods in the respective offers is 12 months. The respective warranty period begins with the delivery of the goods to the customer. The above restrictions do not apply in the event of willful or grossly negligent breaches of contract or malice, in the event that culpable damage to life, health or body has arisen, within the scope of a quality and / or durability guarantee, provided that we have given one with respect to the delivered goods, or as far as the scope of the product liability law is opened. For the rest, the statutory provisions apply to the guarantee, in particular the two-year limitation period from Section 438 (1) No. 3 BGB.

13. Guarantees

13.1 Should manufacturers of the products you have selected offer a manufacturer's guarantee, this only obliges the manufacturer and not ZWOD, unless ZWOD has expressly given the customer a guarantee.
